PRIVACY POLICY

By visiting or using the services of Fidelity Internet Marketing Inc. (“Fidelity”) website at https://fidelityinternetmarketing.ca, applications, or other online resources provided by Fidelity (collectively, the “Website”), each web user, customer, client or other member of the public (each a “User”) acknowledges that they may be providing personal information to Fidelity.

Fidelity is committed to protecting the privacy and personal information of each User. To accommodate any concerns with how personal information is protected, Fidelity has created this Privacy Policy which details how Fidelity collects, uses and discloses personal information obtained by Fidelity when Users are visiting the Website, utilizing the services provided via the Website, as well as information received from cookies and other downloadable material.

By visiting the Site or by using the services, you accept the terms and conditions of this Privacy Policy.

Application of this Privacy Policy

The obligations set out in this Privacy Policy apply to all Users of the Website.

This Privacy Policy applies to all personal information (defined below) collected by Fidelity through the operation of the Website.

The Privacy Policy does not apply to third-party online resources to which the Website may link, where Fidelity does not control the content or the privacy practices of such resources.

This Privacy Policy may be amended at any time, with or without notice or notification, so we recommend periodically reviewing it. Continued use of the Website or Services following the posting of any change to this Privacy Policy constitutes acceptance of all changes. We suggest printing or saving a local copy of this Privacy Policy for your records.

What is Personal Information?

Personal Information is defined in the Personal Information Protection and Electronic Documents Act (“PIPEDA”) as information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization. In other words, it does not include the information that one expects to find on a business card or information that is available in public records. Personal Information includes, but is not limited to, a User’s name, mailing address, telephone number, e-mail address, facsimile number, age, gender, marital status, financial status, credit card information, credit history, interests, browsing preferences, web logs, internet protocol addresses, network and server particulars, and/or other information relevant to the Website, promotional and marketing activities (“Personal Information”).

Consent

By using the Website, the User consents to the collection, use, and disclosure of the User’s personal information in accordance with this Privacy Policy. If the User does not consent to all aspects of the Privacy Policy, they must immediately cease using the Website. Please note that the User’s access and continued use of the Website will be deemed as consent by Fidelity.

Where appropriate, the legal basis for our processing of Personal Information is either consent (where we ask for it) or that the processing is necessary for providing the Website and/or services and is carried out in our legitimate interests, which are further explained in the “How We May Use Information We Collect from You” section.

A User who does not consent to the collection of personal information or who withdraws their consent should immediately cease use of the Website and inform Fidelity (see contact information below). If a User withdraws or limits its consent for Fidelity to collect or disclose personal information, Fidelity may be limited in its ability to provide services or access to certain aspects of the Website. Personal information will only be collected or disclosed without the consent of the User in the limited circumstances that are expressly permitted by law.

What Information Do We Collect Directly From the User?

Fidelity collects personal information in one (or more) of three ways:

  1. Volunteered Information

Fidelity may collect personal information that is voluntarily provided by a User utilizing the Website (i.e. data or comments entered into forms or data fields on the Website).

  1. Information from Public or Third-Party Sources

Fidelity may collect personal information about Users who register on the Website from public or third-party sources to verify professional credentials and identity.

  1. Information Collected from a User’s Computer

Fidelity collects information from a User’s computer when a User accesses the Website. The information collected includes but is not limited to: a User’s Internet Protocol (IP) address, domain name, browser type, date and time of a User’s request and information provided by tracking technologies, such as cookies.

“Cookies” are small amounts of data that are transferred to your web browser by a web server and are used to collect and store information about a User. The ways we use cookies include, but are not limited to: tracking which webpage variant a visitor has seen, monitoring traffic patterns, and to store preferences. Cookies also allow us to calculate total visits and views per webpage, variant, account, and client sub-account. First-party cookies on Fidelity landing pages are anonymous and cannot be used on their own to identify an individual. You can turn off your web browser’s ability to accept cookies. But, if you do that, certain parts of the Website may not work for you.

“Single-pixel tags”, also known as web beacons or web tags, are graphics that function similar to cookies. Single-pixel tags are not visible. Single-pixel tags are used to collect information in web logs that do not identify a User personally such as web pages viewed, the web site a User came from and the advertisement the User clicked on to visit the Website. Single-pixel tags are also used to confirm whether promotional or other commercial e-mail messages that are sent via the Website are opened.

  1. Information Collected from a User’s Customers

Fidelity may collect personal information regarding the User’s clients, visitors and customers depending on the services the User has consented to.

Fidelity may also anonymously use log information on operational systems, and identify categories of Users by items such as domains and browser types to properly manage the Website.

Fidelity only collects personal information that is necessary to accomplish the specific goals for which it is being collected.

How Do We Use Information Collected Directly From the User?

Fidelity collects, uses, and discloses personal information to provide the User with the services and to understand, improve and enhance the services. This includes, but is not limited to, the right to conduct research, analyze trends, monitor traffic usage, and examine the ways in which our users engage with the services. In particular, personal information is collected for the following reasons:

  • to register a User for, and facilitate a User’s participation in, certain areas of the Website (for example, by collecting a User’s name and email address in order to contact the User);
  • to properly advertise and promote the services of Users through targeted advertising to the end consumer;
  • internal record keeping;
  • to customize the Website according to a User’s interests; and
  • such other uses as may be permitted or required by applicable law.

In certain limited circumstances, Fidelity may be required to release or provide access to personal information in response to a subpoena, search warrant, court order, law, or regulation. In such case, Fidelity will take all appropriate measures to ensure that Users’ personal information is protected to the greatest extent possible while Fidelity cooperates fully with court and law enforcement authorities in this regard.

How We May Disclose Information We Collect From the User

Fidelity will only share your information with Third Parties in accordance with your instructions or as necessary to provide you with a specific service (for example to track and record customer telephone conversations and our integration with a third party’s landing pages for websites) or otherwise in accordance with applicable privacy legislation. As a general rule, unless permitted in this Privacy Policy, we do not and will not sell, rent, share, or disclose your Personal Information without first receiving your permission. When we disclose your Personal Information to Third Party service providers, we take reasonable measures to ensure that the rules set forth in this Privacy Policy are complied with.

This policy is not intended to place any limits on what we may do with data that is aggregated and/or anonymized so it is no longer associated with an identifiable Customer or user of the services (“Aggregated Data”). We may use your Personal Information to generate Aggregated Data for internal use and for sharing with Third Parties on a selective basis

Please note that your Personal Information may be stored and processed in any country in which we engage Third Party service providers. By using the Site and/or Services, you consent to the transfer of information to countries outside your country of residence, including the United States, which may have different data protection rules than in your country. Such information is subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country.

Our practices regarding your Personal Information will at all times continue to be governed by this Policy and we will comply with PIPEDA requirements.

How do Users Limit the Collection, Use and Disclosure of Information?

Users may withdraw their consent to Fidelity’s collection, use, and disclosure of personal information at any time, subject to legal and/or contractual restrictions and upon reasonable notice, by contacting Steve Gould at Fidelity (see contact information below).

Notwithstanding the above, certain personal information may be collected automatically when a User visits the Website. Continued use of the Website will be deemed by Fidelity to be consent to obtain any personal information that derives from Users’ use of the Website notwithstanding the fact that such User has previously communicated their withdrawal of consent for such collection.

Users may choose not to provide personal information by not entering it into forms or data fields on the Website when prompted. Users should be aware that choosing not to provide this information may limit their ability to access all features of the Website.

Users who previously agreed to permit the use of personal information for marketing, advertising, or other promotional purposes may revoke their consent by making a request in writing to Steve Gould at Fidelity (see contact information below).

How Does Fidelity Protect the User’s Personal Information?

Fidelity employs physical, administrative, and technological security safeguards appropriate to the sensitivity of the information.

Fidelity will take all reasonable and legally required steps to protect personal information as it is transmitted from a User’s computer to the Website or other online resources and servers. Fidelity will also protect personal information from unauthorized access, disclosure, alteration or destruction.  Fidelity ensures that all affiliates and other third parties that are retained to perform services on Fidelity’s behalf and are provided with personal information have an adequate Privacy Policy to protect the information. It is a User’s personal responsibility to secure a User’s own copies of any logins, passwords and related access codes used on or for the Website.

Please note, security risks on the internet cannot be eliminated, and Fidelity cannot and does not guarantee that a User’s personal information will not be accessed in ways not otherwise described in the Privacy Policy.

What is the Retention Policy of the Personal Information Collected?

Fidelity will keep your personal information only as long as is reasonably necessary for the purposes described in this Privacy Policy, or such longer period as may be required by applicable law. The exception to this retention policy is if the User has opted to include the call tracking and recording services offered by Fidelity. The User’s personal information collected will only be retained for a period of ninety (90) business days (the “Retention Period”). After the Retention Period, Fidelity will delete or remove the personal information, or personal identifying data from such information, in a manner that is secure and which respects the privacy of the information.

Access and Correction to Personal Information

Users may access, update, and correct inaccuracies in personal information in Fidelity’s possession, subject to certain exceptions prescribed by law.

Upon written request, Fidelity will provide a User with any personal information in its possession to the extent required by law.

If a User would like to access any of its personal information or believes that any of the personal information collected by Fidelity relating to a User is incorrect or incomplete, they should contact Steve Gould at Fidelity’s (see contact information below under “Further Information”).

Miscellaneous

Third Party Links and Web Sites

The Website may contain links to other third party web sites or internet resources, which are not affiliated with the Website, nor provided by Fidelity, and are not subject to the Privacy Policy.  The User assumes any risk associated with any third party links or web sites. Fidelity assumes no responsibility or liability for, or control over any third party web sites or their collection, use and disclosure of a User’s personal information.

Privacy Policy Amendments

To accommodate amendments to the Website, changing technology, and legal developments, the Privacy Policy may be revised in Fidelity’s absolute discretion and without any prior notice or liability to the User or any other person.  Fidelity’s collection, use and disclosure of the personal information through the Website will be governed by the version of the Privacy Policy in effect at that time when the information is collected, used, or disclosed.  New versions of the Privacy Policy will be posted on the Website and will be available upon request from Fidelity.  A User’s continued access, use and/or dealings with the Website after any amendments to the Privacy Policy, will signify a User’s consent or continued consent to the collection, use and disclosure of personal information in accordance with the revised Privacy Policy.
